ADEM Information Requests:

If you would like to review available public records, your request must be made in writing and should be submitted to the ADEM Public Records Officer. Please submit your request well in advance of the time that you need to review the records because the documents you request may not be immediately available.

The Public Records Officer will contact you to schedule your appointment. Request should be submitted via e-mail at records@adem.state.al.us, fax to 334-271-7950, or mailed to ADEM Public Records Officer, P.O. Box 301463, Montgomery, AL 36130-1463.

ADEM Emergency Response:

Spills and fish kills should be reported during normal office hours to the nearest ADEM Field Office or 24 hours per day by calling the Alabama Emergency Management Agency at 1-800-843-0699, you can also contact them by email at http://ema.alabama.gov. The ADEM response staff can be reached after hours in emergency situations through the Alabama Emergency Management Agency.

ADEM Appeal of Administrative Action    (see R. 335-2-1)

 

Any person aggrieved by an administrative action of the Department, other than the issuance of any rule or regulation or emergency order, may file with the Commission a request for a hearing to contest such action within thirty days* of such action.

 

File appeal within 30 days for all actions except rules and regulations which is 45 days.

 

“Administrative action” includes any issuance, denial, repeal or modification any permit, notice of violation, order, rule or regulation.

 

ADEM Petition for Rule Making      (see R. 335-2-2)

 

Any person may petition the Commission to adopt, amend or repeal a rule by making and filing a written petition in accordance with Rule 335-2-2-.04.

 

Petitions are assigned to the EMC Rule Making Committee and the Department staff will review proposal and make a recommendation to the sub-committee that makes a recommendation to the full EMC.

 

Changes to rules and regulations include upgrading a “water use classification” on a waterbody, e.g. Outstanding Alabama Water or Outstanding National Resource Water classifications.
